1 Introduction

These Terms and Conditions (”Terms”) govern your access to and use of the Agent Pro Access subscription service (”Service”) provided by True Horizon (”Company,” ”we,” ”us,” or ”our”). The Service includes a custom agent profile featured on our network, downloadable real estate forms, premium e-books for lead generation and conversion, monthly agent tools, member-only training videos and webinars, email support, and access to a community forum. By subscribing to the Service, you (”User,” ”you,” or ”your”) agree to be bound by these Terms, our Privacy Policy, and any additional terms referenced herein

2 Eligibility and Account Registration

2.1 Eligibility

To use the Service, you must be at least 18 years old and have the legal capacity to enter into a binding agreement. By subscribing, you represent and warrant that you meet these eligibility requirements and that the information you provide during registration is accurate and complete.

2.2 Account Registration

To access the Service, you must create an account by providing your name, email address, and payment information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at info@truehorizonre.com if you suspect any unauthorized use of your account.

3 Subscription and Payment

3.1 Subscription Fee

The Agent Pro Access subscription is offered at a fee of $500 per year (”Subscription Fee”). This fee grants you access to all features of the Service for a 12-month period, including the custom agent profile, downloadable forms, e-books, monthly tools, training videos, webinars, email support, and community forum access

3.2 Payment Terms

Payment for the Subscription Fee must be made via a valid credit card or other accepted payment method at the time of subscription. By providing your payment information, you authorize True Horizon to charge the Subscription Fee annually, including any applicable taxes, until you cancel your subscription in accordance with these Terms.

3.3 Automatic Renewal

Your subscription will automatically renew for an additional 12-month term at the thencurrent Subscription Fee unless you cancel at least 30 days prior to the renewal date. We will notify you via email at least 30 days and 7 days before the renewal date to remind you of the upcoming charge. You may cancel your subscription at any time through your account settings or by contacting us at info@truehorizonre.com.

4 Access and Use of the Service

4.1 License

Upon payment of the Subscription Fee, True Horizon grants you a non-exclusive, nontransferable, revocable license to access and use the Service for your personal or professional use, subject to these Terms. This license does not permit you to share, distribute, or resell any content from the Service, including downloadable forms, e-books, videos, or webinars.

4.2 Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Prohibited uses include, but are not limited to:

Copying, distributing, or modifying any content from the Service without prior written consent.
Using the Service to engage in fraudulent, deceptive, or harmful activities.
Sharing your account credentials with others or allowing unauthorized access to the Service.
Attempting to reverse engineer, hack, or interfere with the Service’s functionality.

4.3 Content Ownership

All content provided through the Service, including real estate forms, e-books, videos, and webinars, is the intellectual property of True Horizon or its licensors. You may download and use the content for your personal or professional use as permitted by your subscription, but you may not distribute, sell, or reproduce the content without our express written permission.

5 Refund Policy

5.1 7-Day Refund Window

True Horizon offers a 7-day money-back guarantee for the Agent Pro Access subscription. If you are not satisfied with the Service for any reason, you may request a full refund within 7 calendar days from the date of your initial subscription payment (”Refund Period”).

5.2 Refund Eligibility

To be eligible for a refund, you must meet the following conditions:

The refund request must be submitted within the 7-day Refund Period.
You must not have downloaded or accessed any premium content, including real estate forms, e-books, training videos, or webinars, during the Refund Period.
Your account must not show evidence of misuse, such as excessive downloads or sharing of content.

5.3 Refund Process

To request a refund, contact our support team at info@truehorizonre.com with your account details and a brief explanation of your reason for requesting a refund. If your request meets the eligibility criteria, we will process the refund within 5 business days, and the Subscription Fee will be credited back to your original payment method. Upon refund, your access to the Service will be terminated immediately.

5.4 Non-Refundable Scenarios

After the 7-day Refund Period, all Subscription Fees are non-refundable. Additionally, no refunds will be issued if you have accessed premium content during the Refund Period, if you cancel after the Refund Period, or if your account is terminated due to a violation of these Terms.

5.5 Automatic Renewal Refunds

If you fail to cancel your subscription before the automatic renewal date, the renewed Subscription Fee is non-refundable, except as required by applicable law.

6 Cancellation and Termination

6.1 User Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at info@truehorizonre.com. Cancellation will take effect at the end of the current billing cycle, and you will retain access to the Service until that date. No prorated refunds will be provided for cancellations after the 7-day Refund Period.

6.2 Termination by True Horizon

We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, if you violate these Terms, engage in fraudulent activity, or fail to pay the Subscription Fee. Upon termination, you will lose access to all content and features of the Service, and no refunds will be provided unless required by law.

7 Intellectual Property

7.1 Ownership

The Service and all content, including but not limited to real estate forms, e-books, training videos, webinars, and the community forum, are the exclusive property of True Horizon or its licensors. All rights, titles, and interests in the Service and its content are reserved.

7.2 User-Generated Content

By participating in the community forum or submitting feedback, you grant True Horizon a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your user-generated content for the purpose of operating and improving the Service. You represent and warrant that your content does not infringe on any third-party rights.

8 Privacy and Data Protection

8.1 Data Collection

We collect and process your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your data as described in the Privacy Policy.

8.2 Data Security

We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You are responsible for safeguarding your account credentials and notifying us of any unauthorized access.

9 Limitation of Liability

9.1 Disclaimer of Warranties

The Service is provided on an ”as-is” and ”as-available” basis. True Horizon disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses.

9.2 Limitation of Liability

To the maximum extent permitted by law, True Horizon shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim arising from these Terms shall not exceed the Subscription Fee paid by you in the preceding 12 months.

10 Indemnification

You agree to indemnify, defend, and hold harmless True Horizon, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11 Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles.

11.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in Albuquerque, New Mexico, and the decision of the arbitrator shall be final and binding. Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

12 Modifications to the Terms

We may update these Terms from time to time to reflect changes in the Service or applicable laws. We will notify you of material changes by posting the updated Terms on our website and sending an email to the address associated with your account. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.

13 Miscellaneous

13.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional agreements referenced herein, constitute the entire agreement between you and True Horizon regarding the Service.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
